ALWAYS THE DEFINITIVE TEXT ON THIS COMPLEX SUBJECT – NOW IN A NEW EDITION FOR 2014-2015

An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers

Tax planning for expatriate clients is certainly a specialist area, fraught all too often, with eye-watering complications. True to the tradition of Tolley’s, however, help is at hand via the new ‘Tolley’s Expatriate Tax Planning 2014-15’. We have already defined Amanda Sullivan’s work of reference as ‘definitive’ in previous editions and it continues to be so.

Within this volume of some 900 pages there are, we estimate, hundreds of worked examples which guide the practitioner through the intricacies of advising clients in any number of typical situations: the employee with more than one employment… or the ex-pat who is ‘resident, but not ordinarily resident in the UK.’

Confused? You won’t be, with this book to hand. Amanda Sullivan, an expert in this field, has the knack of rendering complicated tax situations perfectly clear. Her aim is to guide the reader though the detailed implications of all expatriate tax planning issues, with the focus on how such issues impact on employers and employees. The book therefore covers the taxation both of UK employees working abroad and foreign nationals working in the UK.

Mitigating and reducing exposure to tax and social security contributions as well, is of course the primary aim. And for the employer, minimizing tax risks in the event of employee non-compliance is also an important consideration. Sullivan warns that ‘the tax authorities in many countries, including HMRC in the UK, have developed their expertise regarding expatriate employees as part of a deliberate focus on areas of potential tax avoidance.’

Reflecting this important shift in emphasis, this new edition incorporates the changes in the Finance Act 2014, together with the latest HMRC guidance. Of particular interest is the new anti-avoidance legislation for dual employment contracts to April 2014 -- and there is a wealth of additional new material besides.

The book excels as research resource, with extensive tables of statutes, statutory instruments, cases and international and European legislation.

To help you navigate, there is a detailed table of contents, numbered paragraphs throughout and a useful index at the back, plus a handy list of abbreviations and references. The ten appendices are full of useful information, including, for example, Appendix 4 which lists eight ‘steps to calculate UK-assessable earnings 2013/14 onwards.’

If your professional remit includes the tax affairs of expatriate UK clients abroad, or foreign nationals working in the UK, (whether or not you are working with a third party specialist in this area), you need this book, ideally as a permanent fixture on your desk.

The publication date is cited as at July 2014.
